Please read these Terms & Conditions ("Terms") carefully before using the HookShare application and website (the "Service") operated by HookShare ("we", "us", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

HookShare is a video hook testing platform that allows creators to:

• Upload or import short-form videos
• Generate AI-powered hook variants with captions
• Create public polls to test which hook performs best
• View results and statistical analysis of votes

3. User Content & URL Imports

Ownership: You retain all ownership rights to the videos you upload or import. By uploading or importing content, you grant us a limited license to process, store, and display your content as necessary to provide the Service.

Your content, your responsibility: The Service allows you to upload videos directly or import them via URL (e.g., from YouTube, TikTok, Instagram, or other platforms). Regardless of the method used, you represent and warrant that:

• You are the original creator of the content, or you have obtained all necessary rights, licenses, and permissions from the rights holder to use, upload, and process the content through HookShare
• Your use of the content does not violate the terms of service of any third-party platform from which it originates
• Your content does not infringe on any third party's intellectual property rights, including copyrights, trademarks, or rights of publicity
• Your content does not contain illegal, harmful, or offensive material
• Your content complies with all applicable laws and regulations

URL import feature: The URL import feature is provided as a convenience for importing your own content from platforms where you have published it. HookShare does not endorse, encourage, or authorize the downloading or reproduction of content owned by third parties without their express permission. You assume all legal responsibility for any content you import.

Indemnification: You agree to indemnify, defend, and hold harmless HookShare and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) content you upload or import; (c) your violation of these Terms; or (d) your violation of any third party's rights, including intellectual property rights.

4. Copyright Infringement & DMCA

HookShare respects the intellectual property rights of others. If you believe that content on HookShare infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent at dmca@hookshare.app.

Your DMCA notice should include:

• A description of the copyrighted work you claim has been infringed
• The URL or other specific location on the Service where the infringing material is located
• Your contact information (name, address, telephone number, email)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
• Your physical or electronic signature

Repeat infringers: We reserve the right to terminate the accounts of users who are determined to be repeat infringers. We may also remove or disable access to content that is alleged to be infringing at our sole discretion.

5. AI-Generated Content

The Service uses artificial intelligence to generate hook variants, captions, and video clips. You acknowledge that:

• AI-generated content may not always be accurate, appropriate, or suitable for your needs
• You are responsible for reviewing all generated content before sharing it publicly
• We do not guarantee the quality, accuracy, or effectiveness of AI-generated hooks

6. Public Polls

When you create a poll and share the link, the generated hook variant clips become publicly accessible to anyone with the link. You understand that:

• Anyone with the poll link can view the variant clips and vote
• Votes are collected anonymously
• You can delete your video and its associated polls at any time

7. Prohibited Uses

You agree not to:

• Upload or import content that you do not own or have the right to use
• Use the URL import feature to download or reproduce content belonging to third parties without their permission
• Use the Service for any illegal or unauthorized purpose
• Attempt to manipulate poll results through automated voting or other deceptive means
• Interfere with or disrupt the Service or its servers
• Upload malicious files or content designed to harm the Service or other users
• Use the Service to distribute spam, phishing, or other unwanted communications
• Use the Service as a general-purpose video downloading tool

8. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, HookShare shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
